The ODP issue will impact hundreds of billions (if not trillions) in pharmaceutical product sales.
  • Successfully defended Google against Flypsi over patents concerning Voice over IP technology, first in a hard-fought six-day jury trial where Flypsi’s damages were limited to $12 million dollars as a lump sum covering the entire life of the asserted patents. A coordinated strategy between the district court and the PTAB led to the PTAB finding every challenged claim of every challenged patent (including every asserted claim) invalid.
  • Obtained a complete victory in an arbitration on behalf of Daiichi Sankyo, a global pharmaceutical company and the largest in Japan by market cap, in a hotly contested, complex commercial dispute with Seagen, Inc., which sought to extract tens of billions of dollars, plus worldwide ownership of Daiichi Sankyo’s proprietary portfolio of pioneering drugs for treating patients suffering from deadly cancers, plus global patent rights to more than 350 Daiichi Sankyo patents and patent applications, from our client.

Cooley secured a summary judgment victory involving 11 patents across the district court and the PTAB which was then affirmed at the Federal Circuit.
  • Defending Niantic, the maker of the Pokémon Go mobile game in a hotly contested augmented reality patent case brought by plaintiff NantWorks, a conglomerate founded by a Los Angeles billionaire. Successfully knocked out the three remaining patents in the ongoing patent infringement suit in the Northern District of California.
