  • Advice to universities on complex free speech and academic freedom issues following the Hamas attacks on 7 October 2023 and Israel’s military action in Gaza. The focus of this work has concerned social media activity and other public comments made by academic staff from a pro-Palestinian perspective which gave rise to internal and external complaints and adverse media coverage, typically alleging anti-semitism or other unlawful content.
  • Advising the Universities and Colleges Employer’s Association on sector-wide guidance on responding to the period of industrial action. Advised the numerous universities (including a number in the London region) on their response to this action, including detailed advice on withholding pay for staff taking part in the boycott.
  • Assisting King’s College London for about 18 months on their Global Mobility Project regarding remote workers overseas. Our work is ongoing but has so far included assistance with the University’s overseas working policy, training to the HR team on legal issues arising from overseas remote working, ad hoc advice on issues arising during the implementation of the policy.

Mills & Reeve LLP

Mills & Reeve LLP is well known for working on complex and significant education-related matters, such as mergers and collaborations. The department also assists with regulatory, freedom of information, data protection, litigation and liability issues.   • Advised the University of Essex in connection with an inquest into the death of a former student in its Halls of Residence. The tragic case concerned a student who had been withdrawn from the University but continued to remain in Halls of Residence without a legal right to do so. No adverse findings in respect of the University were reached.
  • Provided a huge amount of training to institutions across the country in relation to free speech. Advised Universities UK and contributed to its briefing on preparing for the new legislation. Advised on dozens of complaints that discourse around the conflict in the Middle East has crossed the line from freedom of speech into anti-Semitism and/or Islamophobia or support for terrorism.
  • Acted for a Russell Group university in respect of complex and multi-faceted litigation brought by an academic member of staff. The academic commenced litigation against the university in 2016 and has since brought claims of whistleblowing; victimisation; harassment; and unfair dismissal.

Blake Morgan LLP
