Initially instructed in director’s disqualification proceedings,  Catherine Addy KC ended up acting for the Competition and Markets Authority in a case brought by Advanz Pharma Corp Ltd concerning fines exceeding £35m levied on several drug companies after it was discovered that one company was paid not to launch an anti-nausea drug, leading to the NHS facing a 700% price rise over four years. David Mumford KC is acting for the provisional liquidator of a Bahraini company suing to recover fraudulently misappropriated shares in a listed Palestinian company, while new joiner Anna Lintner is frequently instructed on behalf of the Secretary of State in director disqualification proceedings, including against eight former directors of Carillion plc.

Serle Court


Serle Court  is considered one of the leading sets for contentious company matters, with its members frequently represent directors or shareholders in internal and minority shareholders disputes, derivative actions, and winding up petitions.  Daniel Lightman KC  acted for minority shareholders in Re Flybondi Ltd, concerning ultra-low-cost airline based in Argentina which faces allegations that directors breached their duties in failing to enforce $18m of investment commitments made by majority shareholders. Lance Ashworth KC acted for The Hut Group and its director shareholders in unfair prejudice claim concerning dilution and removal of rights.

South Square's members frequently combine market-leading expertise in corporate insolvency and civil fraud with an in-depth knowledge of company law matters. David Allison KC acts for the joint administrators on the conduct of the $5bn administration of Greensill Bank. Opposing Felicity Toube KC, Allison KC also appeared for the McDermott construction group in relation to its successful restructuring of over $2bn of financial debt and over $1bn of unsecured debt. Turning to the set's juniors William Willson appeared for banks at the high-profile convening hearing for the Thames Water restructuring plan.

Wilberforce Chambers's Lexa Hilliard KC represented the defendant in BHS Group Limited & Ors v Chappell, Henningson and Chandler, a liquidators’ claim against former directors of BHS for breach of fiduciary duty, negligence and wrongful trading. Terence Mowschenson KC acted for the respondents in O’Keefe and another v Caner and others, in which joint liquidators of Jersey companies brought claims alleging breach of directors’ duties and misfeasance. Thomas Grant KC handled very high-value s.238 proceedings in the Cayman Grand Court concerning the value of the minority shareholdings in Chinese social media company Weibo, while, turning to the set's juniors, Sri Carmichael recently acted as sole counsel defending a £50m fraud claim arising out of the liquidation of the Thomas Cook Group.

XXIV Old Buildings


XXIV Old Buildings has ‘a very strong insolvency, commercial and chancery practice, with barristers at all levels’. In Al-Thani & anr v Al Thani & ors,  Stephen Moverley Smith KC and Edward Cumming KC were opposing on opposing sides of a case confirming that, at common law, company shares are transmitted, upon the death of a shareholder, in accordance with the law of the deceased’s place of domicile, in respect of the BVI Companies Act.

New Square Chambers


New Square Chambers maintains a strong roster of company law specialists among the junior ranks. David Eaton Turner  represented the defendant in BHS Group Limited (in liquidation) v Parladorio, who was allegedly a de facto or shadow director of the company and was pursued for wrongful trading and misfeasance. Another standout junior is Mark Hubbard, who in Landl & Ors v Hogg & Ors acted as sole English counsel for the liquidators of a protected cell company that collapsed following the death of the key player in a property development fund in Guernsey litigation. Robin Hollington KC has retired.
