A 3-day winding up letter was issued, and after negotiations, a payment of £1.2million was made.
- Instructed by Alpha to apply for an injunction restraining Signal from advertising a winding up petition against Alpha. The alleged debt of £1.2M which was the subject of the petition flowed from a failed financing deal. The client asserted a complex cross claim based on fraudulent misrepresentation in order to obtain the injunctive relief sought, and was successful in its application in the insolvency court.
- Instructed by a client to pursue recovery of a debt where the supplier’s invoices had been assigned to the client pursuant to the terms of an invoice finance agreement. The firm issued a county court claim, where the judgment in default was obtained and sent to the debtor with a final demand prior to enforcement action being undertaken.
